Service Warranty
HOMEOWNER'S GUARANTY AND LIMITED LIFETIME
WARRANTY
National Foundation Repair Co., Contractor, hereby guarantees and warrants to its named customer under the below referenced contract as follows, to-wit:
(1) Contractor has completed all work specified under the subject contract.
(2) Contractor has performed said work in a first class workmanlike manner and in compliance with all applicable building codes and ordinances.
(3) Contractor warrants that the section(s) of the structure's foundation included under the subject contract has been raised to level as near as possible.
(4)(A) Contractor warrants that the foundation of the subject structure shall remain level as near as possible, subject to limitations, to-wit:
1. This warranty applies only to the section(s) of the foundation where work was performed by Contractor as specified under the subject contract.
2. This warranty commences on the dale Customer accepts Contractor's work which said date is set forth herein below, and shall be valid and remain in effect for a period of five years or for so long as Customer continues to own the subject structure, whichever should be the longer period..
3. Customer remedy under this warranty shall be as set forth under B. and C. immediately below.
(B) Should settlement occur in the first full year of this warranty, then Contractor shall rework, adjust and raise said settlement level as near as possible, all at no charge or cost to the customer.
(C) Should settlement occur thereafter during the period of this warranty, then Contractor shall rework adjust and raise said settlement level as near as possible, and Customer shall pay Contractor for labor only.
(5) Contractor makes no warranty with respect to, and this warranty does not cover, the following, to-wit:
A. Settlement caused by asks of God, such as earthquakes, hurricanes and floods.
B. Settlement caused by casualty or by the acts of others, such as fire, vandalism or explosion.
C. Consequential damage to the roof and interior parts of the subject structure. including fixtures,
interior slab and walls not part of specified work.
D. Shrubs and plants.
(6) Contractor's warranty in favor of its Customer, as limited and defined herein, is exclusive and in lieu of all other warranties, express or implied. Customer's remedy shall be as set forth herein and does not extend to incidental, special or consequential loss.
(7) Contractors warranty is in favor of its Customer only. Provided however, should Customer sell the subject structure to another party. Customer's Buyer, then this warranty shall automatically extend to Customer's Buyer, but limited to the duration of the initial five year period set forth under (4)(A)2. above.
(8) Should the subject contract specify that Contractor shall stabilize the designated section(s) of the subject structure(rather than rais to level as near as possible), then this warranty guarantees said work as stabilized only. Accordingly, should settlement occur, then Contractor shall rework and raise said settlement only to the stabilized position as specified and accepted by Customer under the subject contract.
(9) This guaranty and warranty is not binding upon Contractor unless Contractor unless Contractor is paid as agreed by Customer.

HOMEOWNER'S GUARANTY AND TWO YEAR WARRANTY
National Foundation Repair Co., Contractor, hereby guarantees and warrants to its named customer under the below referenced contract as follows, to-wit:
(1) Contractor has completed all work specified under the subject contract.
(2) Contractor has performed said work in a first class workmanlike manner and in compliance with all applicable building codes and ordinances.
(3) Contractor warrants that the section(s) of the structure's foundation included under the subject contract has been raised to level as near as possible.
(4)(A) Contractor warrants that the foundation of the subject structure shall remain level as near as possible, subject to limitations, to-wit:
1. This warranty applies only to the section(s) of the foundation where work was performed by Contractor as specified under the subject contract.
